The Court said that the law is clear. The Child Labour (Prohibition & Regulation) Act, 1986, the Minimum Wages Act, 1948 and the Employment of Children Act, 1976, make it an offence to employ children in any hazardous occupation. The Court held that while the law provides for punishment, it does not provide for the compensation of the victim. It also held that the child was solely responsible for his or her actions.
After the enactment of the Child Labour (Prohibition & Regulation) Act, 1986, India strengthened its commitment to child labour. This act prohibits the employment or employment solicitation of children below the age of 14 in any industry or mines or any industry engaged in mining.[27] The act also prohibits the employment of children in any industry or mines engaged in mining for a work period of more than eight hours a day, or 36 hours a week.[27]
